Terms of service

These Terms govern access to PeakGevity websites, apps, and related services (collectively, the “Services”) operated by the PeakGevity team (“PeakGevity,” “we,” “us”). By creating an account, downloading our app, or using the Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally able to enter a contract. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
2. The Services
PeakGevity provides software for fitness, nutrition logging, habit tracking, and related wellness education. The Services are not medical devices, telemedicine, or emergency services. Output may be incorrect or incomplete. You are responsible for decisions about exercise, nutrition, and health.
3. Accounts and security
You are responsible for safeguarding credentials and for activity under your account. Notify us promptly of unauthorized use via the contact channel listed on our Support page.
4. Subscriptions, trials, and billing
Paid features may be offered through Apple App Store or Google Play in-app purchases. Pricing, taxes, renewal, and refunds are controlled by the applicable platform’s rules and the terms presented at checkout. To cancel or change a subscription, use your platform account settings.
5. Acceptable use
- No harassment, hate, or sexual content involving minors.
- No attempts to probe, disrupt, or bypass security or rate limits.
- No scraping or bulk extraction beyond what we expressly permit.
- No use of the Services in violation of export or sanctions laws.
6. User content
You retain rights to content you submit (e.g., logs, photos). You grant us a license to host, process, back up, and display that content solely to operate and improve the Services — not to sell identifiable health journals to advertisers.
7. Intellectual property
PeakGevity trademarks, branding, and software are owned by PeakGevity or its licensors. Do not copy our product UI, training content, or assets for competing services without permission.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAKGEVITY AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100), EXCEPT WHERE PROHIBITED BY LAW.
10. Indemnity
You will defend and indemnify PeakGevity against claims arising from your misuse of the Services, your content, or your violation of these Terms.
11. Termination
You may stop using the Services at any time. We may suspend or terminate access for conduct risk, legal obligation, or material breach after notice where reasonable.
12. Changes
We may update these Terms. We will post the revised Terms with a new effective date and, where required, provide additional notice. Continued use after the effective date constitutes acceptance.
13. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules, unless your jurisdiction mandates otherwise. Courts in Delaware have exclusive jurisdiction except where prohibited — counsel should revise this clause for consumer jurisdictions and arbitration preferences.

Privacy policy

This Policy explains how PeakGevity collects, uses, shares, and retains information when you use our websites and apps.
1. Information we collect
- Account data: email, authentication identifiers, and profile basics you choose to provide.
- Health and fitness data you enter: workouts, nutrition logs, photos, notes, goals, and similar content you submit.
- Device and technical data: device type, OS version, app version, crash diagnostics, and coarse usage events to keep the product reliable.
- Support communications: messages you send us and attachments you include.
2. How we use information
- Provide, secure, and personalize the Services.
- Process subscriptions and authenticate access.
- Debug, prevent fraud, and improve performance.
- Communicate service updates and, where allowed, product education.
- Comply with law and enforce our Terms.
3. AI features
When you use AI-assisted features, inputs and outputs may be processed by subprocessors under contract. We do not use your identifiable health logs to train broadly available foundation models. If we introduce optional research or model improvement programs, we will describe them separately and obtain consent where required.
4. Sharing
We share information with infrastructure providers (e.g., cloud hosting, database, authentication) who process data on our instructions. We do not sell personal information for cross-context behavioral advertising. We may disclose information if required by law or to protect rights, safety, and integrity.
5. Retention
We retain information while your account is active and for a limited period afterward for backups, legal obligations, and dispute resolution. Exact retention schedules should be finalized with counsel and operational policy.
6. Your choices and rights
Depending on where you live, you may have rights to access, correct, delete, or export personal information, and to object to certain processing. Contact us via Support to exercise rights. We will verify requests consistent with law.
7. International transfers
If you access the Services from outside the United States, your information may be processed in the United States or other countries with appropriate safeguards as required by law.
8. Children
The Services are not directed to children under 18, and we do not knowingly collect their personal information.
9. Changes to this Policy
We will post updates here and adjust the effective date. Material changes may require additional notice under applicable law.

PeakGevity provides educational and organizational tools for fitness and general wellness. It does not provide medical advice, diagnosis, treatment, or emergency services. Always consult a qualified healthcare professional before starting or changing an exercise or nutrition program, especially if you are pregnant, post-surgical, have cardiovascular or metabolic disease, or take prescription medications.
If you experience chest pain, severe shortness of breath, fainting, sudden neurological symptoms, or any emergency, call your local emergency number immediately.
AI-generated suggestions can be wrong. You are responsible for reviewing and approving any plan changes. Individual results vary based on genetics, adherence, sleep, stress, and other factors we do not control.
